What is Work Comp?

In California, Workers' Compensation ("work comp") is a mandated insurance policy, paid for by the employer, which provides benefits to employees injured at work or on the job. In return for providing these benefits, the employer is protected from civil litigation brought by the employee. In other words, the employee receives workers' compensation benefits in exchange for not being able to sue the employer because of a work related injury.

The workers' compensations system is governed by thousands of labor codes, regulations and case laws that are applicable to all who interact within the system, including the injured workers, employers, insurance companies, doctors, attorneys, judges, vocational rehabilitation councilors, etc. These rules and how they are applied will dictate the outcome of your workers' compensation claim. These regulations are referenced throughout this web site and will be preceded by the following; LC (Labor Code), CCR (California Code of Regulations), or IC (Insurance Code).
